This chat has not been committed to in the manifest sent to the police and to the Prosecutor's Office, because I forgot it existed in the few days I had to prepare those applications. I rediscovered the existence of this chat preparing this dossier, specifically when trying to find evidence to close the continuity gap in my chat with Saba.

The full chat with this phone number, up to the last update of this dossier, is included here.

    Hi, good afternoon.
I am Luís, owner of unit 16-11in Next White.
I am writing regards the compensation of Next for condominium services.
I have been approached by Saba, your manager, claiming I owe Next six months of service fees.
In spite of all previous transgressions that Next has committed against us, I will treat the issues of the fees orthogonally to that.
The price is not a problem, and neither is the retroactive nature of the request, except that you should use the real amount of square meters for the price, since Next stole some square meters from our apartment.
The major problem is the contracts Next wants me to sign.
Next sent two separate contracts, with many very objectionable clauses, such as:

    1. Next having the right to manage my property as an apart-hotel (I am the owner of a private residential unit, and I will manage it).
    2. Next having the right to cut my utilities (I will grant no such right to Next and will treat any such action as the crime that it is).
    3. Next having the right to unilaterally change the condominium rules.
    4. Next having the right to change the price arbitrarily.

I purchased my unit as a private residential unit, and that is how it is registered.
I would not like to be a parasite, however, and am willing to compensate Next.
However, I would like no subtle transfer of my rights as an owner to Next in the fine print.
Is it possible to write a simple services contract, where a prescribed set of services is compensated at a prescribed price, with limited and foreseen price adjustment?

    Dear Luís,

Thank you for your message and for sharing your concerns in detail.

First of all, please note that under the Transfer Agreement concluded between you and the previous owner, Mr. [redacted], all rights and obligations of the previous owner towards NEXT were fully transferred to you as the new owner of the unit. Accordingly, the obligations related to management and service fees apply to the current owner of the apartment.

We would also like to clarify that you purchased an apartment not only in a residential building, but in a hotel-type complex. This is precisely why the owners benefit from centralized management, maintenance, security, and other services, and why the conclusion of management and service agreements is required. On our side, we have undertaken an obligation to provide high-quality services, and we are also required by applicable regulations to have such agreements in place with all unit owners in the complex.

At the same time, please be assured that signing the management and service agreements does not result in any transfer or limitation of your ownership rights. The agreements are standard documents that have been previously agreed and signed by all owners, and they are intended solely to regulate the scope of services and the relationship between the parties.

Regarding your concern about rental management, please note that if you do not wish to transfer your apartment for rental management, we can conclude an additional agreement on the suspension of the management (rental) arrangement, while maintaining the service agreement for services.

With respect to service fees, any adjustment of the price is not based on the unilateral will of the company. Any potential increase is grounded on objective factors such as market conditions, inflation, operational costs, and other relevant economic indicators.

    Hi,

Thank you for clarifying your position.
In all honesty, I do not recollect ever signing such a document.
As I recall, the only document I co-signed with Mr. [redacted] was the standard property transfer document at City Hall.
    But I could be mistaken.
Would you be able to provide me a copy of this document signed by myself?

  6. Gvantsa on 2/4/2026, 9:07 AM (UTC)

    Dear Luís,
Unfortunately, I do not have access to the agreement concluded between you and the previous owner, as this document should have signed between the two of you.
At the same time, regardless of the form of the transfer agreement, by acquiring the apartment in the NEXT White multifunctional complex, you obtained ownership in a property that forms part of a multifunctional complex. Accordingly, the conclusion of management and service agreements with the complex operator is a mandatory condition applicable to all unit owners.
For this reason, the obligation to sign the relevant management and service agreements arises from the nature and legal status of the complex itself.

    Edited
  7. I call attention to the fact that the previous message, which contains an ad-hoc legal theory on why I am obligated to sign two documents, was edited. I do not believe I saw the original, and I have no access to it anymore.

    > On our side, we have undertaken an obligation to provide high-quality services, and we are also required by applicable regulations to have such agreements in place with all unit owners in the complex.

Regarding this claim, some services provided to us by Next were of very low quality or even negligent. Namely:

    1. Your sales team mislead us during the purchase by stating they consulted the engineering team about our renovation project, as well as about the line dividing our apartment and the public area.
    2. Your engineer (Shota) embargoed our renovation based on bogus claims that it was not possible, and refused to look across the hall for another apartment joined like ours.
    3. The plastic gas pipe in our apartment, embedded in concrete, was ruptured, and we are supposed to believe you delivered it in good condition, and that somehow our renovation workers broke it.
    4. Your customer relations person (Lola) is a serial liar. Of the about 6 weeks we spent without gas, two can be attributed to her lying non-stop to us on how we should approach the problem. She also lied about consulting your engineers before our renovation (though it might have been the fault of upper management).
    5. Your staff was unhelpful when our power meter malfunctioned, and mislead us to believe there was a 2 Lari debt with the electricity company, resulting in a whole work day lost without electricity.

The agreement put a ridiculous 10 Lari per day fine on Next for failing to uphold this "high quality".
In fairness, how much do you think Next should owe us for these transgressions?

If you have any complaints or further concerns, please address them to our official email address: info@nextgroup.ge, cc us: g.magularia@nextgroup.ge, g.lomadze@nextgroup.ge
Your request will be reviewed with the Chief Legal Officer and the relevant department representatives.
Unfortunately, I am unable to assist further at this stage by whatsapp communication.

  10. Luís Fernando on 2/4/2026, 9:14 AM (UTC)

Well, as I said, I don't believe such document exists.
It does not arise of Natural Law that Next gets to force me to sign an agreement.
Next sold me this apartment without any terms or conditions, and that is part of the reason and market value of that apartment.
If I knew I would have to have so many rights stripped from me like this, I would not have made the purchase.
What I have signed and committed to is ownership of this private residence.
That includes my private contracts with the utilities companies, as well as the utilities infrastructure that they own.
No sane legal system would force an individual to sign a contract.
I agree our situation is not ideal because of the current lack of compensation to Next.
But we shall resolve it with a fair contract that does not trample on my rights as an owner.

  11. Luís Fernando on 2/4/2026, 9:14 AM (UTC)

    Ok, I will contact them.

  12. I wrote the email with my grievances to g.magularia@nextgroup.ge and g.lomadze@nextgroup.ge. Next never engaged with them.

    Hi, good afternoon.

Since it looks like it will take some time for Next to respond, I propose that I pay Next for the service previously provided in exchange for a written receipt.
If it's agreeable, I'll collect the evidence that supports the correct apartment size and send it to you.

  15. Gvantsa on 2/5/2026, 10:44 AM (UTC)

    Hello,
yes, preparing the answer may take some time. Meanwhile, you can measure your apartment, including the balcony, and send the information to us via the same email.

  16. Luís Fernando on 2/5/2026, 10:49 AM (UTC)

Yes, I will gather the documents and send you a copy today, as well as to the email of the two people you referred me to.

  17. Luís Fernando on 2/5/2026, 2:35 PM (UTC)

Hi, the total unit size is 103.805m2.

Below I attached the registration of the two units, the extra space included in the plan, and a picture of the corner Shota the engineer forced into our home, which is 9.8cm x 204cm.
