Subject:Demand for the removal of the elevator access-control system

To the management of Next White LLC and Next Hospitality LLC

I am the registered owner of apartments 16-11 and 16-12 at 27 David Mamuladze Street, and, as per my registered titles, a co-owner of the building's common property, including the elevators.

You have withheld elevator access from me, conditioning the issue of chips on my settling an alleged debt and signing a document waiving all claims against Next Hospitality LLC. My apartments are on the sixteenth floor.

The consequences have been these. My wife and I have carried our groceries and our drinking water up sixteen floors on foot. On one occasion I returned home suffering from heat exhaustion and was made to plead with your reception staff before I was permitted to use the elevator; of the two present, only one was willing to help. The system also obstructs couriers, deliveries and visitors from reaching apartments in the building.

The debt is asserted under two contracts sent to me on 28 January 2026, neither of which I have signed. One bears the date 13 November 2024 and cites passport number YE528452, which was issued in December 2024. That document could not have existed on the date it bears. The other bears the date 1 August 2025 — the month from which you claim fees retroactively — although it was sent to me almost six months later, and it is drafted throughout to presuppose a purchase agreement between us that does not exist. I bought the apartments from the previous owner. He denies signing any such agreement with you, and your legal representative has declined to produce any either. In any event, obligations he may have assumed do not pass to me without my signature.

It is that second document, at clause 5.2, by which you grant yourselves the power to withhold elevator use pending payment. You are applying it to a person who never signed it.

Saba Tsiskaradze repeatedly told me that all owners must sign these contracts, and continued to insist after I told him that a contract which must be signed is coercion. His stated reason was that Georgian regulations required it. He did not produce any reference to them.

Your own representatives have confirmed, in writing on 30 June 2026 and orally on 1 July 2026 before witnesses, that the Act of Handover waives no claims. You refused to amend the text to say so. You continue to demand my signature on it.

In my view, this conduct engages Article 360 of the Criminal Code (arbitrariness — enforcement of a claimed right outside legal process), Article 150 (coercion) and Article 362 (making or use of a forged document). It is also an interference with common property within the meaning of Article 172 of the Civil Code.

Accordingly, I formally demand that you immediately:

  1. Remove the access-control system from the building's common property.

  2. Pending removal, and without prejudice to that demand, cease withholding my access — without payment, without signature, and without any further condition.

I require your written response within 14 days.
I will treat silence as a refusal of my demands, and as a decision not to dispute the facts set out above.
